vida editorial team: 2026 will bring some innovations in labor law. Which ones are particularly important for vida members?
Robert Steier: As of 1 January 2026, the legal status for nurses to be admitted to heavy labour has been improved. In addition, uniform notice periods now apply to workers and employees. Special regulations for seasonal industries such as tourism have been abolished. Also new are uniform tip flat rates nationwide. The Heat Protection Ordinance also came into force this year. This benefits employees who work outdoors at high temperatures, such as in public transport. And with the new partial pension, older employees can voluntarily reduce their working hours and at the same time receive a pro-rata pension and continue to receive wages or salaries.
vida editorial team: There has also been more protection for freelancers since 2026. Why?
Robert Steier: For the first time, collective agreements can also be applied or concluded for freelancers. In addition, there are uniform minimum standards, for example with regard to notice periods. This is an important first step. Our goal remains to include freelancers in the Labour Constitution Act. This means that they can also set up a works council.
vida editorial team: Speaking of the works council, where do you still see legal gaps here?
Robert Steier: More and more employers are trying to prevent the establishment of works councils. The number of proceedings due to dismissed works councils and contested works council elections has risen significantly. We therefore demand: The prevention of a works council must become punishable. In addition, there is a need for better protection against dismissal for employees who convene a works meeting to elect the works council.
